India Honest agrees with what Ex. Supreme Court judge Markandey Katju  intended by askng for the bigger need of the hour, "a lot of cleaning up to do in the world of judiciary first". It is much needed before all the Collegium hasty recommendations for transfers and appointments of Judges are confirmed without approval of the draft Memorandum of Procedure (MOP) for appointment of Judges is accepted and formalised.

Justice Katju Challenges CJI  Cji Thakur Unhappy

Ex. Supreme Court judge Justice Markandey Katju has lashed out at the CJI Thakur Supreme Court and its committee led by former Chief Justice of India R.M. Lodha, by giving a statement that their intention to clean up cricket in India may be good, but it cannot be done by “throwing the Law to the winds.”

He bitingly said that what the Supreme Court has done is totally unconstitutional and illegal. This is in violation of principles of the Constitution. Under the Constitution, nation has legislature, executive and judiciary. There is broad and clear separation of functions. Make laws is a legislature’s prerogative  and if the judiciary starts making laws as is done here then one is setting a dangerous precedent.



Chief Justice of Supreme Court of India today questioned Narendra Modi led Central Government whether it is trying to bring the entire Judiciary in India to an unfortunate “Grinding Halt.” He also accused Modi Govt.of sitting on the recommendations given by Collegium for transfer and appointment of Judges to High Courts across the country.

CJI T.S.Thakur made it clear to the Center Govt. through Attorney-General Mukul Rohatgi that the Govt. of the day is forcing the apex court judicially intervene and order for calling for every file sent by the SC Collegium to the Government for its clearance.

Apparently not satisfied by Rohtogi’s repeat assurance that it would be taken up at the “highest level”, CJI Thakur said that do not force us to ask where the files are… and also don’t force us to judicially intervene in the matter… do not try to bring this Judicial institution to a grinding halt… That will not be the right thing to do.”


Just because Govt. is working on draft Memorandum of Procedure (MOP) for appointment of Judges, but it is no excuse to freeze appointments in the meanwhile.

He said if there is a problem with a name suggested by SC, then at least send the file back.  SC can look into it, but such a logjam is getting things very difficult,” Chief Justice Thakur observed.
