Corruption , Favouritism Rose Highest in Last One Decade

The Central Bureau of Investigation filed charge sheets against three cement companies: India Cements, Bharathi Cement, Penna Cement and  named N Srinivasan,the vice chairman as an accused in the corruption probe involving the son of Andhra Pradesh's late chief minister YS Rajasekhara Reddy. The CBI questioned Srinivasan a couple of times last year, and charged India Cements with criminal conspiracy, cheating, criminal breach of trust and falsification of accounts.

Srinivasan has invested some Rs 140 crore in various businesses of Jagan Mohan Reddy alegedlly in return for favours. The investigating agency accused senior bureaucrats Adityanath Das and M Samuel for  issuing government orders allotting land, water and limestone mines in favour of India Cements. But has  not named the then irrigation minister, Ponnala Laxmaiah, who issued government orders favouring India Cements to draw large quantities of river water. 

Jagan Mohan Reddy, who represents Kadapa in the Lok Sabha, broke away from the Congress to form his own political outfit soon after his father Rajasekhara Reddy died in a helicopter crash in 2009. He was arrested in May last year and now along with his auditor Vijay Sai Reddy,  named as first and second accused in all the eight charge sheets filed so far. 

There are two basic facts :

a) Industries and individual persons were favoured in the allotment of land, water and limestone mines illegally (out of turn, thus depriving others to get that ) by the Late Rajasekhara Reddy led Congress government, through the then irrigation minister, Ponnala Laxmaiah, who accommodated falsification of accounts and cheating in lieu of money .

b) Jagan Mohan Reddy, the son of the that time Andhra Pradesh's Congress chief minister  late YS Rajasekhara Reddy, received Rs 140 crore invested in various of his businesses, as alleged in return for favours for those illegal allocation of mines and that is now charged as corruption.  

A very simple analysis states the following conclusion :

A) the allocation of limestone mines illegally is similar to what is alleged in the Coalgate, where coal was allotted illegally,

B) this was done in lieu of money and other material benefits and assets, received indirectly by the relatives or associates of one or other Congress ministers very much same as alleged in case of Coalgate,

C) in each of the cases the facilitator of the cheating was some one powerful in the ruling government, that is  almost similar to Coalgate,

D) the fraud was carried in the tenure of  Late Rajasekhara Reddy , he has made it possible as the Congress party Chief Minister of Andhra Pradesh, and it was as the head of cabinet ; but  not as the father of Jagan Mohan Reddy ;that is as his first constitution responsibilities are as the chief minister nor as a father of curropt son (also for similarity refer Railgate ) .

Implication : As the crime was conducted by the that time Congress party and that party is still holding the control of the government now,though with same set of persons, ministers except a different Chief Minister. As such why the CBI should not ask the Governor for dismissal of this corrupt government of same people and party to facilitate proper investigation and independentely charge all the conspirator ministers and facilitator bureaucrats involved ? 

Late Rajasekhara Reddy was selected by all the MLA's of Congress party and recommended to Governor to be their Chief Minister. Is not this lawfully correct that all the cabinet members holds joint responsibility for all the  deeds past or present done by that cabinet, which is controlled and guided through by their central leadership ?

Wise men ask if Osama is dead now, nobody in Al Qaida or Al Qaida itself will be responsible for their past misdeeds ?

We Indians are very much selective and easily be fooled by our elected representatives and we never opt to nail down the criminal tendency of falsification, cheating and corruption, that is why this evil is making such a "rapid progress in geometrical proportion" in the last decade.




Will CBI Ever Succeed to Complete Coalgate Scam ?

Union Minister Manish Tewari said that all predecessors of Prime Minister Manmohan Singh and ministers who held the coal portfolio from 1993 should also be summoned by CBI, if he has to face the agency in Coalgate probe.

Yes, why not ? If it helps in identifying the propagators, conspirators, silent and dumb supporters of this  1.86 lakh crores Coalgate scam and so even why 1993, why not from 1947; only if the Union Minister for Broadcasting Manish Tewari guarantee a time bound result of the investigation and charge sheet filed before the elections.

Sorry, this has never happened in past as one finds in case of Bofors scandal long back and currently in cases of CWG, 2G spectrum, Railgate and many more; and again it will never be possible to find the culprits of this Coalgate for the knowledge of the people of the nation.

Again using the same parameters Mr. Manish Tewari, why not it is under your consciousness and morality ethics to raise and investigate the communal riots in India since seventies or even eighties with Bhagalpur riots or 84 Sikh massacre or thousands of more such riots , but here your buck stops only and only at 2002 Gujarat riots, just  to fool the minority votes in your pocket.

How being a MP from Punjab, you forget the plight of injustice to the major population of Sikhs in your state Punjab in 84 communal massacre at the hands of Congress men and supporters. Is not this double speak of such political leaders that has lowered the head of Indian democracy in the eyes of world. This type of moral breakdown has been made possible only in Congress Rule, that 125 crore people's nation India is humiliated in the forum of International Olympic Association.

Union Minister Kamal Nath's remark that the PM will make himself available to CBI in the Coalgate investigation if a formal request is made, has  provoked Mr.Tewari to ask for investigation of all the coal ministers from 1993, but the question is who is stopping Congress from ordering that ?

The problem with Congress people is that, as they are well aware that  many of their ministers and PM are trapped in the scam and they want to use every dirty tricks in the book, including removal of important  files, just to delay the completion of the investigation.

Only these tactics have prompted  BJP leaders Sushma Swaraj and Arun Jaitley accused the government of trying to sabotage the investigation into the missing coal block allocation files and sought to know why the Prime Minister is not being questioned and an FIR lodged on the "stolen" files. 

Prime Minister is Not Above Law and Will Have to Present to CBI

In continuation of Prime Minister Manmohan Singh earlier assurance on the floor of the house that he has nothing to hide ,he has now accepted to present himself before the CBI.

The Parliamentary Affairs Minister Kamal Nath said, "The Prime Minister is not above law and will have to present himself for questioning if the CBI summons him." The statement came after the Monsoon Session of Parliament was lost to acrimony over the Coalgate issue, where the opposition led by BJP was insisting on a statement from the Prime Minister that he will face CBI probe.

Why Congress did not agree to this on the floor of the Parliament and facilitated its smooth functioning ? What moral right to blame the opposition for disrupting the  parliament when in the most cases of corruption like commonwealth game scam,2G scam, passing the Jan Lokpal bill, railgate bribery case or this coalgate , the Congress led UPA was never willing to debate on the floor of house but always avoided for days to months it in the name unending internal investigation report to come, and still they blame others for non functioning. 

Was it not in the game plan : that not to face the opposition and the representative of people in the parliament but to manage the scandal separately with government controlled "so called autonomous CBI".

This statement of the Parliamentary Affairs Minister Kamal Nath is shame to his role as a parliamentary minister, where he has been hand in glove in  tarnishing and diminishing the supremacy of the Parliament.

This delaying tactics and fraudulent practises on such a  national importance subject matter of 1.86 lakh crore Coalgate scam, is deplorable on most moral grounds and taken away all the fame in people's eyes of an honest Prime Minister of Congress. 

What is the Mystery Behind the Missing Files of Coal Blocks ?

As the confusion and doubt behind the missing coal blocks allocation files is growing day by day as CBI sources also confirm that the missing files  as per their details have not been made available to them and those are very important for the probe into the coal blocks allocation scam................There are several important companies involved whose files are missing, like Adhunik Corporation Ltd, Jharkhand Ispat, Rathi Steel ; Push Steel ; Tata Sponge, as many of them are already charge ...........and there is gross difference intentionally created about the number of files actually missing ; their contents; as well their identity with the accused concerned persons as the Coal Minister Shriprakash Jaiswal has told Parliament that seven files, 173 applications and nine documents related to coal blocks allocation are not traceable, while the CBI had asked for 43 files, 176 applications and 17 other documents to carry on with investigations....................http://indiahonest.blogspot.in/2013/09/the-mystery-behind-missing-files-of.html

It confirms the view of INDIA HONEST : Is not it is part of the conspiracy : "not to clear the haze or confusion about the status of missing files till the Monsoon session of the Parliaments comes to an end that is by the second week of September 2013".


Will the Nation or the History Ever Forgive these Traitors ?

D.G. Vanzara, DIG of Police (under suspension) an under trial prisoner tendered his resignation from service with renunciation of all the post-retirement benefits on the following grounds: As stated in his letter the following parts are extracted for the judicious analysis .

Vanzara letter's Point A) : A monstrous episode of Godhra train burning and equally horrible post-Godhra riots in Gujarat provided a pretext to Pakistan based terrorist outfits like Let, JeM and D gang under the direct supervision of ISI, to "convert Gujarat into another Kashmir" by exploiting the sentiments of the Muslims all over the world. It was in this context that series of acts of terrorism like foiled attack on Rathyatra; bomb blasts at Godhra, Derol, Mehlol and Lunawada; bomb blasts in six AMTS buses of Ahmedabad City; Memco scooter blast; Nehrunagar cycle blasts; firing on Shri Niraj Jain at Vadodara and on Shri Laliwala at Surat; firing on Shri Jaideep Patel at Ahmedabad; firing on Shri Jagdish Tiwari and killing of Shri Haren Pandya; fourteen attack on Akshardham Temple at Gandhinagar etc., took place in quick succession which seized common people of Gujarat with fear and apprehensions. 

Vanzara letter's Point B) : Jihadi Terrorism, thus, began to spread like a forest fire in all directions of the state with all its dreaded ramifications. Everywhere the police was clueless and that phase was almost a beginning of the anarchy in the state. Gujarat, having very long coastal and land border with Pakistan, was virtually on the path of becoming another Kashmir. It was in this context that "the pro-active policy of zero tolerance for terrorism" was adopted by the government of Gujarat at the highest level of its hierarchy. The said policy of government was most efficiently implemented by the Gujarat Police in general and by Crime Branch and ATS in particular as a part of their duty whereby all terror related crimes were detected, several national and international terror networks were busted which included the number of encounter cases also. It was the Epic struggle launched by the officers/men of Crime Branch and ATS who tirelessly continued to wage war against those who had been waging war against India by working day in and day out, for years together at the cost of their health, security and family well being only and only in the greater interest of state, society and country. 

Vanzara letter's Point C) : I can say with pride that my officers and men could not only successfully prevent Gujarat from becoming another Kashmir, but they were also instrumental in providing a solid atmosphere of durable peace and security in the state which, in turn as a natural corollary, elevated the image of this government on one hand and cleared the path of development on the other. I state with all my humility that, but for the sacrifices made by me and my officers in thwarting the onslaught of initial disorder in the state, the "Gujarat Model of Development" which this government is so assiduously showcasing at the national level would not have become possible. 

HONEST INDIA observation : In such a big country like India at least more than 1000 alleged killings of terrorists and anti national criminals in police encounters takes place. How many of them are genuine and how many of them are fake, indeed when considered by the police as genuine are indeed believed to be fake, thus it  is question beyond a fair answer presented by one or other authority; only the God can know the truth ?

According to a Home Ministry 555 cases of alleged fake encounters by police, defence and paramilitary forces were registered by the National Human Rights Commission (NHRC) since April 1, 2009 till February 15, 2013. Uttar Pradesh recorded the highest number of alleged fake encounters in last four years -- 138.

Manipur recorded 62 alleged fake encounters, Assam 52, West Bengal 35, Jharkhand 30 and Chhattisgarh 29 during the last four years. Out of such a large number of alleged fake encounters there was  first ever conviction in  Mumbai, a sessions court held 21 persons including 13 policemen, guilty for the fake encounter of alleged Chhota Rajan aide Ramnarayan Gupta in 2006, while acquitted former encounter specialist Pradeep Sharma who was the prime accused in the case.

HONEST INDIA reasons : If such is the volume and severity of the fact and truth finding ambiguity, it is a serious question for the nation to ponder upon from at least two angles :

a) Human rights abuse angel: Human rights abuse is serious offence and lacuna for any civilised democratic society, and it seems in India it is weekned completely by the political establishments, using it selectively with selfish political bias.

b) Patriotic and national interest angles : From another important aspect if the nation consider these encounters like Sadiq Jamal, Tulsiram Prajapati, IshratJahan, Shohrabuddin , Batala House and thousand of alleged encounters in Jammu and Kashmir,Manipur or Nagaland etc.

The point of importance is when the that time DIG Vanzara draws a critical picture of state of affairs in Gujarat in the above points of his letter and the IB (Intelligence Bureau of Govt. of India) vouches the seriousness of the anti national activities by the ISI supported jihadi elements implementing it, what justification India's central government has to engage the premier investigating agency of India, that is CBI to so vigorously fighting hook or cook in maligning and taming their own country's patriotic police force of Gujarat and along with officers of IB, to the level of demoralising them.

Was not it at the instance of shameless ,semi/anti national, unpatriotic, communal and dividing leader Congress Dig sir, and that is  just for sake of some cheap political rivalry ?

Was not by such actions the Congress led  Government playing in the hands of anti India forces like ISI or their fronts like LeT,SIMI or IM ? 

Will the nation or the history ever forgive those, who are waging proxy war against the honest, obedient  and dedicated officers them, by torturing and BLACKMAILING them to submission and depriving them the civil liberty, confining them away from their home for long periods by delaying the legal proceedings ; just to tame them, and for this misusing Government agencies like CBI etc. in coercion against such brave, honest and loyal officers of police or security establishments, any where in India ? 

How the time, money or energy of CBI and of various Courts ,that the Govt. is using for one or two so alleged fake encounters ( that is just for selfish and personal political gain) will justify the merits and fate of thousands of such type of fake encounters cases and human rights abuse cases , murders, and lastly  ever increasing rape cases remaining untouched ?

India’s premier investigating agency CBI called the Ishrat Jahan killing a fake encounter and filed its first charge sheet in the case against seven police officers. The main grudge was only the satisfaction of some of our biased political class, that has found another opportunity to indulge in scoring brownie points over each other. With the similar instructions the CBI is also probing many of such fake encounters "Only in Gujarat" ; including the 2003 Sadiq Jamal fake encounter case in Gujarat, where several officials of the Gujarat Police  allegedly involved.

Another shameless investigation initiated by Congress leader Digvijay Singh in Batala House encounter, as  Digvijay Singh had created a big furore going public with a demand for a judicial probe into the encounter calling it fake encounter, in which even a brave and patriotic officer of Delhi police sacrificed his life and it was alleged to be fake ( thus suspecting the loyalty of the brave slain officer). This was done only because it involved few misguided persons belonging to the "minority community", but to the utmost disgust of Dig sir the court in Delhi ruled that the 2008 encounter in Delhi's Batala House was a genuine gun battle between the terrorists of Indian Mujahideen and police. But the nation has to pay price, because some national leaders are patronising them with fake stamp.




CWG Suppliers issued Tax Demand; No decision on Kalmadi

In the year 2011 - 12, on the basis of various reports of corruption related to the Commonwealth Games surfacing, the Central Vigilance Commissioner directed the CBI to probe the matter, and in its full-fledged investigation, specific charges were made against Congress MP Suresh Kalmadi, the former Union minister and controversial chief of the Organising Committee ; and some of Mr Kalmadi's closest aides  including Lalit Bhanot, the Secretary General of the Organising Committee and VK Verma, the Director General. The CBI framed charges against Suresh Kalmadi and nine others today for allegedly cheating, conspiring and causing a loss of over Rs. 90 crore to the exchequer in a Commonwealth Games or CWG-related corruption case and subsequently arrested them. 

"A total of 30 projects or contracts, valued at RS 3,500 crore (approximately) were taken up for technical examination, from 2008 onwards, and as per the  report a number of complaints questioning the quality of works executed and justifiability about the cost escalation were also received. Some of these complaints were directly enquired by the commission and others were referred to CBI and Chief Vigilance Officers.

The Commonwealth Games was mired in alleged corruption in several projects executed by Delhi government and private organisations. Prime Minister Manmohanh Singh had also announced a High Level Committee (HLC) to look into the allegations of corruption. Six reports submitted by the HLC are being examined by a Group of Ministers .

Now after three years in 2013, the finance ministry has issued tax demand notices of at least Rs 240 crore to some private companies and individuals who were involved in the conduct of 2010 Commonwealth Games-related projects, after the CVC detected huge tax evasion,according to annual report of Central Vigilance Commission (CVC) for 2012, which was tabled in the Parliament recently. 

The cunning question  now must be asked what happened to the role of the Congress leaders like Suresh Kalmadi or the factual status of the allegation on Delhi CM Sheila Dixit in the corruption scam ? Are they separately treated without any connection with the companies now served with notices ? If so why ? 




Congress and PMO Related Coalgate Scam Files Missing Or Removed ?

If the media report that the important files relating to Coalgate are lost from the records, it will be such a big blunder, where not only the Manmohan Singh government will be forced into crisis, but more it will be much embarrassing for Indian democracy nationally and credibility at international platform. 

These files are related to the Coalgate scam, where many allegation and counter allegation are made on many Congress's central and state ministers, as well wrongs at the time of last NDA government also are alleged by Congress. Most pathetic the allegation have serious accusation against the supreme head of government, the prime minister Manmohan Singh and his PMO.

The CAG report of 2012 on coal blocks was tabled in the Parliament on 17th August 2012, that blamed that 105 blocks were given to private firms between 1993 and 2009,that gave them likely windfall gain of Rs 1.86 lakh crore from these coal blocks that were indiscriminately allocated on nomination basis instead of competitive bidding.The Central Vigilance Commission asked CBI to enquire into the coal block allocation process between 2006-09, but subsequently expanded the scope of the investigation, also for the alleged irregularities in allocation of coal blocks between 1993 and 2004.

The sensational disclosures made by the Coal Minister Sriprakash Jaiswal, he admitted that some files related to the coal block allocation scam are missing. But it is now come to light that not only files and records of applications for 45 coal blocks allocated from 1993 to 2005 are untraceable but also recommendations made by Congress MP Vijay Darda and forwarded by the Prime Minister’s Office for the Bander block have gone missing.

According to the minutes of the Search Committee meeting held on July 16 and issued on July 29,officials could not find the records of the recommendation made by Congress MP Mr. Darda and forwarded by the PMO for the Bander block allocated to AMR Iron and Steel Ltd.In connection with Coalgate, the CBI raided Mr.Vijay Darda and registered a case against him last year only and  crucial files directly related to PMO missing even one year after continuous working on the basis of those files by CBI, and the surprising revelation that files are removed is made now.

The lost  files also include those which can put light on the truth behind the allegation against NDA ministers , who had vehemently denied the blame, and called the allegation false and untrue and called the blame made only to misguide and delay the investigation. The Coalgate scam investigation is carried out by the CBI under direct observation of Supreme Court and as such the matter and records are sub-judice, a loss of such files will be serious legal and proprietary crisis for the UPA government.

It makes a question mark on which records the investigation agency CBI was working for last 400 days, when those crucial documents and files were not given to them. Probably the CBI was seeing, verifying and assembling the photographs and bio datas of PMO members and their head. 

Astonishing it is only possible in India, where the supreme investigating agency CBI was working without the most important, essential and crucial records showing how the coal block allocation were made, its screening by the committee and the relevant recommendation records and files are not given to them.

The bare admission and disclosure by CBI of loss of files proves that investigators are not vigilant and impartial, may be suitably accused by the Supreme Court not only for the negligence but for charges of criminal collusion in the removal of important files, directly related to the essence of the scam involving  ruling Ministers and PMO. 




How Truly Autonomous CBI Carry the Risk of Potential Misuse ?

As reported in media, the Centre  told the Supreme Court that the CBI's suggestion to make the agency "truly autonomous" appeared to be an attempt to create "an all powerful" CBI director, which is not provided for in the Constitution and "would always carry the risk of potential misuse".

It said,  "Authority without accountability will be draconian, more so when we are dealing with an organisation (the CBI) with police powers of arrest, seizure, raids and confinement. The government works on a system of checks and balances and builds adequate safeguards so that scope of misuse and arbitrary action is minimised,".

The rule equally applies to all and universal like on all the state or central ministers, MLA's, MP's  bureaucratic secretaries and officers, even to all heads and officers of all those regulators like SEBI, CAG, LOKAYUKTS, RAW or IBs etc... The question how it is different in case of CBI as a whole of an institution and why the government whimsically and astonishingly treating "to make the agency "truly autonomous" appeared to be an attempt to create "an all powerful" CBI director which is not provided for in the Constitution and "would always carry the risk of potential misuse".?  How come a director heading the CBI wing will simply become risky unless the vast number of subordinate staff not supporting him in his malafide actions ? 

Yes checks and guards have to be employed, nobody denying this but the question is why this crucial button of check and control remains in the hands of politically installed leaders ? Can anyone guarantee that they (the political leadership) themselves will not become biased and draconian ?

When hundreds of such allegations are regularly made by the same set of people elected political leaders like MLA's, MP's ?, yes at that moment they are in opposition benches, but how one can say that those dully elected representative are  not  responsible and  accountable,  but  the  Home Minster controlling  the CBI is ? 

Is it not a glaring fact that the same CBI is entrusted to investigate at least Seven minister and various ministries and various political leaders of ruling parties ? Yes ironically it is true that the CBI's governing Home Ministry was of course not needed to be investigated.

If someone suggest that why so, the answer is you are foolish in asking such question, how  a SP of Police find fault and investigate the IG of Police ? Yes here remains the anomaly the Supreme Court wanted to rectify, when   it wanted to make this highest investigating institution independent and powerful free from the clutches of  powerful but rampantly corrupt and unashamed, but so called people's elected political leadership.

During  coal scam hearing in the court  the CBI was called almost a "caged parrot" and vowed to make it independent of political interference, and to that court advice the CBI  submitted that it could not remain insulated from political interference as long as it was dependent on government funds and lacked complete autonomy in running its internal affairs and wanted a stable and fixed tenure of three years. 

But the department of personnel objected in its affidavit, "An all powerful director CBI without adequate checks and balances would not be consonant with settled constitutional principles and would carry the risk of potential misuse and may not be conducive to fearless and independent functioning of the organisation at all levels."

Also rejecting the CBI's proposal for an internal vigilance mechanism instead of the accountability commission, the Centre said the chief vigilance officer, who is an employee of the agency, could seldom question the CBI director for potential acts of commission or omission.And added, "The fact that the CBI is outside the purview of the Right to Information Act (except administrative matters) is also relevant in this regard,".

But where it solves the basic question that how the CBI becomes effective and independent, when it has to investigate the Government machinary  time and again in the major national  interest ? Does it serves the purpose of effective security of national interest without the crucial autonomy to do so?

Where is the Rational of Tapping Corporate Lobbyist Niara Radia ?


The Supreme Court bench of Justices G S Singhvi and V Gopala Gowda  questioned the rationality or justification of securing permission for tapping corporate lobbyist Radia's telephone and sternly asked the CBI team probing the spectrum scam to take a fresh look at the sensational cache of telephone calls.The bench  expressed distress that the investigating agencies did not probe the "serious criminality" reflected in the conversations referred to as Radia tapes wondering why the delay or basic justification such power of tapping, when they said, "For five years, they had the tapes and transcripts. It shows serious criminality. But they have not done anything. Are they waiting for court orders," .

HI smells that such methods are used, by obtaining such dictatorial permission of intercepting conversations of politicians, bureaucrats, businessmen or even journalists, in the disguise of "National Interest and Security", only for getting important personal informations and then pass on "those" to their bosses may be political also, and which is inadvertently used or Misused to nail or blackmail someone for their personal objectives, and only very rarely used for national interest.

The Supreme Court observed the issue in a larger context and said,  "We are asking the larger question. There may be thousands of such interceptions which could have a bearing on national interest. Intercepted conversations in this case concern a lady. But in some other case it could be officials who are intensely negotiating sensitive equipment for Navy or Army. The government comes to know of involvement of middlemen or arms dealers and they intercept their conversation. If the agencies do not take any action, what should be done?" But it added, "We pointed out one more area which has got huge significance in modern times affecting governance. They talk very loosely about how to mould a particular decision in a particular manner. The top government officials are aware of it. These are more serious matters. Yet no action has been taken."
